Mesothelioma Compensation for ‘Beloved Dad’

Ernest Croft was an outgoing and confident 91 year old widower. He kept an allotment and regularly played crown green bowls. He loved life and had a loving family around him. Sadly he was diagnosed with asbestos mesothelioma in 2009 and after a short but intense period of illness he died aged 92.
His family were devastated. They contacted John Pickering and Partners LLP to enquire about making a claim for compensation.
Although it was too late for Mr Croft to provide evidence about where he’d been exposed to asbestos, we were able to contact his former work colleagues who confirmed that he’d been exposed to asbestos whilst working as an industrial cleaner at G A Fenner Ltd of Hull.
Mr Croft’s duties included the removal of asbestos pipe lagging from the exhaust pipes of trawlers. He also stuffed mats with asbestos material. During his life he had kept a work diary and within it he provided a clear description of the work he had done at G A Fenner Ltd . This supported the testimony of his colleagues.
As investigations continued an inquest was held into Ernest’s death. A solicitor from this firm accompanied Mr Croft’s family to the hearing and represented them before HM Coroner who ruled that Mr Croft’s death had been caused by asbestos exposure.
Court proceedings were issued against G A Fenner Ltd and the claim settled shortly after.

Mesothelioma is a type of cancer that affects the lining of certain bodily organs. It most commonly affects the lining of the lungs (the pleura) but it can affect other areas including organs in the abdominal cavity (the peritoneum).
More than 2,000 people are diagnosed with mesothelioma every year in the UK and there is one mesothelioma death every five hours. The number of deaths from mesothelioma increased from 153 in 1968 to 1,969 in 2004 and is expected to peak at 2,450 between 2011 and 2015.
The first Action Mesothelioma Day was launched on 27th February 2006. Its objectives were to raise awareness about mesothelioma, to improve the treatment and care of mesothelioma patients, and to lobby for better funding for research into mesothelioma and for the protection and education of people who may be exposed to asbestos.
