You can only get a payment under this scheme if the DWP accepts that you have one of the asbestos diseases listed below. So you have to apply for industrial injuries disablement benefit. If a relative has died, you can still apply for industrial injuries disablement benefit, but should apply immediately after the death.
You should not wait until the result of your claim for industrial injuries disablement benefit before claiming a payment under the 1979 Act.

This scheme is designed to compensate you if you cannot get compensation from the employers who caused your disease, because they have gone out of business.
It is nearly always worthwhile applying for a payment under the 1979 Act even if, on the face of it, you are not entitled to one.
