What to do if You are injured in a Road Traffic Accident

  • Report the accident to the police if you or someone else is injured. Also, tell your own insurers as soon as you can, the same day if possible.
  • At the scene of the accident, get the name, address and telephone number of as many witnesses as possible. Get someone to help you do this. Check the registration number of the car whose driver you blame, and write it down if you can. Write down what the driver says about the accident to you.
  • Think carefully about what you say when giving a statement to the police. Read the statement very carefully and check nothing important has been missed, and make sure what you mean to say has been written down.
  • Do not admit fault immediately after the accident. You may be in shock or confused immediately after the accident.

If you are knocked down by a vehicle, you will almost certainly have a good claim because, even if you are partly to blame, the driver is likely to be at fault as well. If the Judge thinks you were half to blame and the driver half to blame, you get half of the compensation due.
