HGV driver wins more than £1,000,000 compensation in clinical negligence action
This practice has recently settled a clinical negligence claim for a former HGV driver who was injured at Barrow in Furness General Hospital following abdominal surgery. The man, who received over £1,075,000.00 in damages, sustained permanent disabling and very painful injuries when his legs were placed in stirrups during the course of a very lengthy operation. The hospital failed to notice that this caused serious nerve and circulatory damage to his legs which could have been treated. The hospital eventually admitted liability for these injuries. The client’s solicitor, Claire Horton, who manages the clinical negligence work at the practice, ensured that the compensation monies were paid into a Trust for the client, which means that he retains his right to obtain State benefits and payments for a carer from the Local Authority. The man, aged 32, is planning to purchase a suitably adapted bungalow which will enable him to participate in his family life more fully again, despite his disabilities. He is also able to pay for a carer/companion so that his wife, who was forced to give up her job as a Teaching Assistant to look after him, will be able to return to the work she enjoyed. The former HGV driver experienced severe psychological effects because of the pain he endures.
