Occupational Asthma - recently settled case

Our client v

Our client developed occupational asthma as a result of his exposure to harmful chemicals when he worked for the Defendant company. He was exposed to glue which contained a substance known as MDI.

The Defendant company made insulated cladding panels. Our client worked as a general labourer at their premises in Skelmersdale between March and October 2001.

Medical evidence confirmed that our client was suffering from occupational asthma, but the level of disability was fairly minor, it was put at 3 - 4 %.

Although there was modest disability, our client suffered significant loss of earnings as a result of his condition. He suffered ongoing loss of earnings because he had to give up his job with the Defendant company. In addition, his prospects of obtaining future employment were severely restricted as a result of his condition.

We obtained expert evidence from an engineer. The Defendant company admitted liability and the court gave judgment against them.

Our client accepted an offer of £37,500 to settle his claim shortly before trial.
